1.Who we are and what these Terms cover
These Terms and Conditions ("Terms") govern every booking, order, and use of the website of ET-Errand & Cargo Service ("ET", "we", "us"), operated by [full legal name of owner / company], [registered business address, Germany], business registration no. By placing a booking or order — via our website, WhatsApp, email, or in person — you accept these Terms. Where you are a consumer, mandatory statutory consumer rights remain unaffected and always take priority over these Terms.
2.Our services
ET provides three services:
- Cargo & parcel shipping (Europe ↔ Nigeria): doorstep-to-doorstep air cargo between Europe and Nigeria, including free doorstep pickup within North Rhine-Westphalia (NRW) from 10 kg (a pickup fee of €10 applies below 10 kg). Customers in other German or EU cities receive a GLS/DHL label to send their parcel to our hub at carrier cost.
- Market errands in Benin City: purchase of goods on your behalf at markets in Benin City, Nigeria. You pay the exact amounts shown on the purchase receipts, plus delivery and a service commission of 12% of the goods value, confirmed in a written quote before we buy.
- ET-Food supply: Nigerian foodstuff ("Naija Boxes" in sizes S/M/L and wholesale supply for Afro shops), sourced in Nigeria, imported and labelled in accordance with EU food rules, and delivered within Europe.
3.How a contract is formed
Prices, calculators, and offers shown on our website are an invitation to order, not a binding offer. A contract is formed when we confirm your booking or order in writing (normally by WhatsApp or email) after you send your request. For market errands, the contract is formed when you approve our written quote (goods estimate + delivery + 12% commission).
4.Prices, weight, and payment
- Cargo prices start from €7.50 per kg and follow the published price table on our website at the time of booking. Minimum billable weights per service apply as published.
- Air parcels are charged on actual or volumetric weight (length × width × height in cm ÷ 6,000), whichever is higher.
- All prices are in euros. Where we are a small business under §19 UStG, prices show no VAT; otherwise prices include statutory VAT. [Confirm your tax status with your Steuerberater.]
- Payment is due before the shipment departs (cargo/food) or upon quote approval (errands), by SEPA bank transfer or a method we confirm in writing. We do not accept cash sent inside parcels.
- For errands, the customer pays: (a) the exact receipt amounts of the goods, (b) local delivery in Benin City (typically ₦1,500–₦3,500), and (c) the agreed commission (12%, or 10% for weekly/monthly subscription plans; minimum ₦2,500 / €3).
5.Prohibited and restricted items
We refuse and may report shipments containing: cash or high-value jewellery; weapons, ammunition, or parts; illegal drugs; flammables, aerosols, or loose batteries; unprocessed perishable food; counterfeit or undeclared goods; and any item prohibited by German, EU, or Nigerian law. The sender is responsible for the truthful declaration of contents. Costs, fines, or seizures caused by false declarations are borne by the sender.
6.Customs, duties, and delays
Cross-border shipments may be inspected by customs in the EU or Nigeria. Import duties, taxes, or clearance charges levied by authorities are not included in our prices and are payable by the customer unless agreed otherwise in writing. Announced transit times (typically 7–14 days by air, 6–10 weeks by sea) are estimates; delays caused by airlines, shipping lines, customs, strikes, or force majeure do not entitle the customer to compensation, though we will always inform you promptly and pursue the fastest resolution.
7.Packing, pickup, and delivery
- The sender must pack goods safely for international transport. We may refuse or repack (at cost, with your consent) parcels that are unsafe.
- Delivery is completed at the recipient address given in the booking. If the recipient is unreachable, we store the parcel and contact you; repeated failed deliveries may incur a storage or redelivery fee, which we will state in advance.
- For errands, delivery is completed with a delivery photo at the door; the receipt photos we send you are part of the service record.
8.Liability and claims
- We are liable without limitation for intent, gross negligence, injury to life, body, or health, and under mandatory law (e.g. product liability).
- For simple negligence we are liable only for breach of essential contractual duties, limited to the foreseeable damage typical for this type of contract.
- For loss of or damage to cargo, liability is limited to the declared value stated in the booking, and where no value is declared, to the limits customary for international carriage. High-value items must be declared before booking; ask us about declared-value cover.
- Visible damage must be noted at delivery; other claims must reach us in writing (WhatsApp or email) within 7 days of delivery, with photos.
9.Right of withdrawal (consumers)
If you are a consumer in the EU, you have a statutory 14-day right of withdrawal for distance contracts, with these exceptions: (a) transport/logistics services fully performed with your express consent before the period ends, (b) goods made to your personal specification (e.g. a completed market errand purchased on your instructions), and (c) sealed food items unsealed after delivery. 10.Food products (ET-Food)
Our food products are sourced, imported, and labelled in accordance with EU food regulations. Please read ingredient and allergen labels before consumption. Storage instructions on the packaging must be followed after delivery. Wholesale customers (Afro shops) receive commercial invoices and product documentation for their own compliance.
11.Your data
We process personal data (name, addresses, phone/WhatsApp, order details) only to perform the contract, as described in our Privacy Policy. Communication runs primarily through WhatsApp; by contacting us there you acknowledge WhatsApp's own terms apply to that channel.
12.Final provisions
- German law applies. If you are a consumer, this choice does not deprive you of protections of the law of your country of habitual residence.
- The EU Commission's platform for online dispute resolution is available at https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution before a consumer arbitration board (§36 VSBG). [Confirm this choice with your advisor.]
- If any clause of these Terms is invalid, the remaining clauses remain in force.
